Casos de Responsabilidad de Locales<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>A pesar de que los casos de responsabilidad de las instalaciones abarcan una amplia variedad de patrones de hechos y tipos de accidentes, el est\u00e1ndar legal que se utiliza es siempre el mismo.<br \/>\nAntes de que pueda recibir incluso una oferta de compensaci\u00f3n financiera, debe demostrar que dadas las circunstancias, como no retirar los escombros del piso dentro de un per\u00edodo de tiempo razonable despu\u00e9s de que lo supo o deber\u00eda haberlo sabido.<\/li>\n<li><strong>Herida:<\/strong> Sufriste alg\u00fan tipo de lesi\u00f3n en tu persona o emociones<\/li>\n<li><strong>Causalidad:<\/strong> No habr\u00eda resultado herido si no hubiera sido por las acciones descuidadas del acusado<\/li>\n<\/ul>\n<p>La \u00fanica manera en que puede probar la negligencia es cuando tiene suficientes pruebas que muestran lo que hizo el acusado.<br \/>\nLuego, sus acciones se comparar\u00edan con lo que habr\u00eda hecho una persona razonable.<br \/>\nDebe demostrar c\u00f3mo se sintieron cortos en cumplir con su deber de cuidado.  <\/p>\n<p>Su abogado de responsabilidad de locales reunir\u00e1 las pruebas que necesita para probar su caso.<br \/>\nPueden hablar con testigos, o pueden presentar im\u00e1genes de la escena del accidente para mostrar lo que hizo el acusado.<br \/>\nSi presenta una demanda de responsabilidad de locales, su abogado podr\u00eda reunir pruebas adicionales a trav\u00e9s del proceso de descubrimiento, como im\u00e1genes de c\u00e1maras de seguridad o las palabras exactas del acusado que obtendr\u00edan a trav\u00e9s de una declaraci\u00f3n.  <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Entendiendo_la_Negligencia_Comparativa\"><\/span>Entendiendo la Negligencia Comparativa<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Puede haber ocasiones en que el acusado en un caso no tenga toda la culpa del accidente.<br \/>\nEs posible que compartan la culpa contigo.<br \/>\nEn otros casos, la compa\u00f1\u00eda de seguros puede tratar de se\u00f1alarlo con el dedo para reducir la cantidad de dinero que le deben o para evitar pagarle en absoluto.  <\/p>\n<p>La ley de Texas le permite recuperar una compensaci\u00f3n siempre y cuando haya tenido menos del 51% de la culpa del accidente.<br \/>\nSi tiene m\u00e1s de este porcentaje de culpa, se le prohibir\u00e1 recibir dinero en absoluto.<br \/>\nSi usted es parcialmente culpable del accidente, su compensaci\u00f3n se reducir\u00eda por la cantidad de su culpa.  <\/p>\n<p>El sistema de negligencia comparativa le da a la compa\u00f1\u00eda de seguros un incentivo para tratar de culparlo siempre que puedan.<br \/>\nPor ejemplo, a las compa\u00f1\u00edas de seguros les gusta culpar a la v\u00edctima del accidente en un caso de resbal\u00f3n y ca\u00edda, alegando que estaban distra\u00eddos o que no tuvieron el cuidado adecuado. <\/p>\n<p>Es posible que su abogado de responsabilidad de locales deba ser igual de abogado defensor, evitando las acusaciones de que de alguna manera usted tuvo la culpa del accidente.<br \/>\nSi la compa\u00f1\u00eda de seguros persiste en culparlo y se equivoca, puede llevar su caso a los tribunales y un jurado decidir\u00e1 el asunto. <\/p>\n<h2><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>El acusado a menudo asume el deber de cuidado porque es due\u00f1o de la propiedad a la que usted fue invitado.<br \/>\nEste hecho por s\u00ed solo es podr\u00eda haber actuado razonablemente para mantenerlo a salvo ser\u00eda la responsable de sus lesiones.   <\/p>\n<p>Un abogado de responsabilidad de locales realizar\u00eda una investigaci\u00f3n completa del accidente para determinar a qui\u00e9n puede demandar.<br \/>\nPuede haber ocasiones en las que pueda demandar tanto al propietario como a la persona que ten\u00eda el control de la propiedad, dependiendo de las circunstancias. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Causa_directa_de_sus_lesiones\"><\/span>Causa directa de sus lesiones<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La causalidad es un elemento clave de cada caso de lesiones personales.<br \/>\nEn este caso, la causalidad puede significar lo siguiente: <\/p>\n<ul>\n<li><strong>Causa de hecho: <\/strong>Esto tambi\u00e9n se conoce como la prueba de &#8220;si no fuera por&#8221;.<br \/>\nAqu\u00ed, debe demostrar que sus lesiones no habr\u00edan
