presentar una demanda contra el demandado, y la compa\u00f1\u00eda de seguros negar\u00eda cualquier reclamo que usted presente.     <\/p>\n<p>El plazo de prescripci\u00f3n es un plazo estricto y r\u00e1pido.<br \/>\nNo hay margen de maniobra ni por un d\u00eda.<br \/>\nSi no lo hace, incluso en un corto per\u00edodo de tiempo, pierde el derecho a un acuerdo por las lesiones de responsabilidad de sus instalaciones.<br \/>\nNo importa que no haya tenido un abogado.<br \/>\nLa ley no da limosna, y los tribunales son implacables.    <\/p>\n<p>Si no cumple con el plazo de prescripci\u00f3n, su durante un cierto per\u00edodo de tiempo.<br \/>\nDespu\u00e9s de ese tiempo, no tendr\u00edan que preocuparse por ser demandados.     <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Los_distintos_plazos\"><\/span>Los distintos plazos<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Texas tiene un estatuto de limitaciones en casos de lesiones personales.<br \/>\nEl plazo de prescripci\u00f3n de la responsabilidad de las instalaciones es de dos a\u00f1os desde el momento en que se lesion\u00f3 o deber\u00eda haber sabido que se lesion\u00f3 para presentar una demanda.<br \/>\nPor lo general, el plazo de prescripci\u00f3n comienza a correr en la fecha de su accidente porque es cuando se lesiona por primera vez y lo sabe.<br \/>\nSin embargo, es posible que el plazo no siempre comience a correr en ese momento.<br \/>\nHay momentos en los que es posible que no se d\u00e9 cuenta de que ha resultado lesionado hasta alg\u00fan tiempo despu\u00e9s del accidente cuando comienza a sentir s\u00edntomas.<br \/>\nLuego, el plazo de prescripci\u00f3n comienza en el momento en que se enter\u00f3 de sus lesiones.     <\/p>\n<p>Por supuesto, la ley no te o cuando cometi\u00f3 fraude que le impidi\u00f3 enterarse de sus lesiones.  <\/p>\n<p>No querr\u00e1 estar en la posici\u00f3n de tener que argumentar que se aplica una excepci\u00f3n al estatuto de limitaci\u00f3n.<br \/>\nUsted tiene la carga de la prueba para demostrar una excepci\u00f3n, y a menudo es alta.<br \/>\nSi est\u00e1 comenzando su caso tratando de resucitarlo despu\u00e9s de que el presentar su demanda o reclamo tan pronto como lo contrate.<br \/>\nSe necesita tiempo para preparar el reclamo y negociar con la compa\u00f1\u00eda de seguros.   <\/p>\n<p>Lo mejor que puede hacer con su tiempo es entregar su caso a un abogado con experiencia en responsabilidad de locales en la primera oportunidad posible.<br \/>\nSu abogado estar\u00e1 atento al reloj y administrar\u00e1 los plazos de su caso.<br \/>\nEllos se encargar\u00e1n de todos los detalles de su reclamo, lo que le permitir\u00e1 concentrarse en su recuperaci\u00f3n f\u00edsica.<br \/>\nLa clave es no perder el tiempo y hacer todo lo que est\u00e9 bajo tu control.<br \/>\nEn este caso, tal vez lo \u00fanico que est\u00e1 bajo su control es obtener ayuda m\u00e9dica y ponerse en contacto con un abogado.    <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Como_vencer_la_fecha_limite_de_prescripcion_al_presentar_una_demanda\"><\/span>C\u00f3mo vencer la fecha l\u00edmite de prescripci\u00f3n al presentar una demanda<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Algunos abogados le dicen que debe presentar su demanda hoy para vencer el estatuto de limitaciones.<br \/>\nNo hay necesidad de apresurar la presentaci\u00f3n real del caso porque tiene hasta dos a\u00f1os.<br \/>\nEs m\u00e1s importante que su abogado de responsabilidad de locales se tome el tiempo para hacer las cosas bien cuando presenten una demanda en su nombre.  <\/p>\n<p>No obstante, debe estar atento al reloj porque puede perder tiempo cuando se trata de la compa\u00f1\u00eda de seguros.<br \/>\nUsar\u00e1n todas las t\u00e1cticas dilatorias posibles porque tambi\u00e9n tienen el ojo en el reloj y quieren que tenga que apresurarse cuando llegue el momento de encontrar la demanda. <\/p>\n<p>Siempre y cuando presente una demanda en la corte antes de que transcurra el estatuto de limitaciones, su caso debe ser escuchado.<br \/>\nNo importa si presenta la solicitud un a\u00f1o antes de que expire o un solo d\u00eda.<br \/>\nEl proceso legal seguir\u00eda desarroll\u00e1ndose sin importar lo que pasara.<br \/>\nSin embargo, si presenta un reclamo de seguro d\u00edas antes de que expire el plazo de llegar a un acuerdo<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Sus posibilidades de \u00e9xito en un caso de responsabilidad de locales dependen de la evidencia que tenga tanto de responsabilidad como de sus lesiones.<br \/>\nLo que lo pondr\u00e1 en una posici\u00f3n para el \u00e9xito es cuando tenga pruebas de que otra persona hizo algo mal que caus\u00f3 sus lesiones.<br \/>\nSin esta prueba, no tiene derecho a ninguna compensaci\u00f3n.  <\/p>\n<p>En un caso de responsabilidad de locales, negligencia significa que el due\u00f1o de la propiedad, o la persona que tiene el control de la propiedad, no actu\u00f3 razonablemente bajo las circunstancias.<br \/>\nCuando su abogado de responsabilidad de locales es capaz de construir un caso s\u00f3lido a su favor, es
