NPR Wins Motion to Remand in Lumber Liquidators Litigation

In October 2016, Nix, Patterson & Roach filed suit against Lumber Liquidators on behalf of plaintiffs for the manufacture of defective flooring due to excessive levels of formaldehyde emissions.  Lumber Liquidators filed a notice of removal in January 2017 based on the Class Action Fairness Act of 2005, and removed the case to the United Stated District Court for the Eastern District of Arkansas.  The case was remanded to the Pulaski County Circuit Court on February 10, 2017.  Lumber Liquidators subsequently filed a petition for permission to appeal the District Court’s remand order.

On March 13, 2017, the United States Court of Appeals for the Eighth Circuit denied Lumber Liquidators’ petition for permission to appeal the District Court’s ruling.
