Statement Regarding Contingency Fee Arrangements

Nix Patterson prides itself on its ability to advance costs and fees on behalf of its clients, regardless of the size of the case. Each case and each client may require a distinct agreement between Nix Patterson and the client to best meet the client’s needs and the needs of the litigation. Nix Patterson negotiates contingency fees with its clients on a case-by-case basis based on the particular facts and circumstances of the matter. Nix Patterson does not have a set percentage fee or range of percentage fees for contingency fees. If retained on an hourly basis, Nix Patterson’s hourly rates rages from $1,000 to $1,500 per hour for partners, $500 to $900 per hour for senior associates, $300 to $600 per hour for associates, and $200 to $400 per hour for legal assistants and paralegals. Nix Patterson charges contingency fees that are normal and customary for the size and scope of litigation pursued, but they vary by case. Although each agreement may vary, Nix Patterson traditionally advances all costs and fees necessary to bring the matter to conclusion, and Nix Patterson is then paid the agreed contingency fee before deduction of costs and expenses incurred by Nix Patterson. In other words, the reimbursement of costs and expenses incurred by Nix Patterson is typically recovered from the client’s share of any verdict or settlement; provided however, that Nix Patterson’s contract with each client controls over this general statement in the event of a conflict.

Statement Regarding Class Actions

Nix Patterson is exceptionally proud of the recoveries it has achieved for its clients through the years.  Many of our significant recoveries have been in class action litigation. Class actions are a form of aggregate litigation where the claims of many people are litigated by “class representatives” who are approved by the court. The amount recovered by class members in a class action is dependent on the type of harm sought to be redressed, the claims pursued and the damages sought in the case, the success of the case and the terms of the settlement–all of which vary by case. Attorney fees and litigation expenses are taken from the total amount recovered on behalf of the class in most instances, although in some cases, attorney fees have been paid to the firm directly by the defendants in addition to the amount recovered by the class. All class actions settlements receive rigorous court review for fairness to the class before they are finally approved and awards are distributed to clients and fees to the attorneys. Nix Patterson has never received attorneys’ fees from a certified class action without court approval.
