On November 4, 2013, the federal judge overseeing this litigation in Tacoma, Washington denied the defendants’ motion for new trial and motion for judgment as a matter of law, finalizing the $115 million judgment against Illumina along with the eight percent running royalty ordered following a two week jury trial. The jury in this matter found for Syntrix, awarding it $96 million to which the federal court added prejudgment interest running back to 2005, and an eight percent running royalty.
